1. Introduction

These Terms of Use ("Terms") govern your access to and use of the BinRadar website, mobile application, API services, trading tools, market analysis features, real-time data feeds, and all associated content, services, tools, and applications (collectively referred to as the "Platform"). By accessing or using the Platform, you agree to comply fully with these Terms, our Privacy Policy, and any additional applicable guidelines or rules. If you disagree with any part of these Terms, please refrain from using the Platform.

BinRadar provides cryptocurrency market intelligence, trading signals, portfolio tracking, and analytical tools focused on cryptocurrency monitoring and broader cryptocurrency market analysis. 2. Eligibility

To access and use the Platform, you must:

Not have been previously banned or restricted from using BinRadar services

Geographic Restrictions: The Platform may not be available in all jurisdictions. You are responsible for ensuring compliance with local laws, including cryptocurrency regulations, securities laws, and financial data licensing requirements.

3. Account Registration

Registration Requirements

When registering for an account, you agree to:

Provide truthful, accurate, current, and complete information
Maintain confidentiality and security of your login details
Implement appropriate security measures
Be solely responsible for all activities under your account
Promptly notify BinRadar of any unauthorized use or security breaches of your account
Not sell, transfer, or assign your account or login details to another individual or entity
Not create multiple accounts to circumvent limitations or restrictions

BinRadar reserves the right to suspend, deactivate, or terminate your account at its discretion for breaches of these Terms, suspicious activity, or security concerns.

4. Intellectual Property

All content, trademarks, logos, data, algorithms, trading models, analytical tools, and technology on the Platform are owned or licensed by BinRadar or respective third-party owners. This includes but is not limited to:

Proprietary trading algorithms and market analysis systems
Real-time and historical market data compilations
User interface designs and software applications
BinRadar trademarks, logos, and brand elements
Technical documentation and educational materials
API infrastructure and data processing systems

You agree not to:

Copy, reproduce, distribute, sell, or exploit any Platform content or technology without explicit written authorization
Reverse engineer, decompile, or attempt to derive source code from our systems
Create derivative works based on our proprietary algorithms or data structures
Use our trademarks or brand elements without permission
Alter or remove copyright notices, trademarks, or proprietary rights notices

4.1 No Affiliation / Third‑Party Trademarks

BinRadar is an independent analytics and information service.

We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with any cryptocurrency exchange, trading platform, or other third‑party service referenced on this website.

All product and company names, logos, brands, and other trademarks or images featured or referred to within BinRadar are the property of their respective trademark holders. Any reference to a third‑party product, service, or trademark is made for identification and informational purposes only and does not imply any endorsement, partnership, or sponsorship.

5. License and Permitted Use

BinRadar grants you a personal, limited, non-exclusive, revocable, and non-transferable license to access and use the Platform solely for personal purposes and in accordance with your account type limitations.

5.1 Permitted Uses

Personal market research and analysis
Portfolio tracking and management
Educational purposes and learning about cryptocurrency markets
Integration with personal trading tools (subject to API terms)
Sharing insights within our community forums (subject to community guidelines)

5.2 Prohibited Activities

You agree not to:

Use data mining, robots, scraping, or similar automated data extraction methods outside of official API access
Aggregate, redistribute, or commercialize content from the Platform without explicit permission
Introduce harmful software, viruses, or malware, or disrupt the Platform's security and functionality
Exceed API rate limits or attempt to circumvent technical restrictions
Use the Platform for high-frequency trading without appropriate enterprise licensing

5.3 API Usage Terms

7. Community-Generated Content

You can submit various forms of content (posts, comments, reviews, market analysis, trading ideas, etc.) to the Platform. By submitting content, you grant BinRadar a perpetual, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and distribute your content for the purposes of operating and improving the Platform.

7.1 Content Standards

You represent and warrant that:

You have the rights or permission to submit the content
Your submissions do not infringe upon intellectual property rights or privacy rights of any third party
Your content is accurate to the best of your knowledge and not intentionally misleading
Your content complies with applicable securities laws and regulations
You will not impersonate others or misrepresent your credentials or experience

7.2 Content Moderation

BinRadar may, at its sole discretion, remove or moderate user-generated content without prior notification for violations of these Terms, community guidelines, or applicable laws. We reserve the right to:

Remove content that violates our community standards
Suspend or ban users who repeatedly violate content policies
Report illegal activities to relevant authorities
Implement automated content filtering and moderation systems

8. AI Features

Refrain from generating content that is misleading, deceptive, harmful, illegal, or infringing upon the rights of others

11.2 Data and Information Disclaimers

Market Data: Our Platform aggregates data from multiple sources including official exchanges, third-party providers, and community contributions. We do not guarantee:

Service interruptions or downtime
Security breaches affecting user accounts
Third-party service failures or integration issues

12.2 Maximum Liability

BinRadar's total aggregate liability under these Terms will not exceed the greater of:

USD $100, or
The amount you paid to BinRadar for services in the 12 months preceding the claim

12.3 Essential Purpose

These limitations reflect the allocation of risk between the parties and will survive even if any limited remedy specified in these Terms is found to have failed of its essential purpose.

13. Indemnification

You agree to indemnify, defend, and hold BinRadar harmless from all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Your violation of these Terms or applicable laws
Misuse or unauthorized use of the Platform or API services
Your trading or investment decisions based on Platform data or analysis
Any infringement of intellectual property or other rights resulting from your activities or content submissions
Your breach of representations or warranties made in these Terms

BinRadar reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you will cooperate fully in such defense.

The content, privacy practices, or security of third-party websites
The availability, performance, or reliability of external services
Any transactions or interactions you have with third parties
The accuracy of information provided by external sources
Third-party fees, terms of service, or policies

Integration Risks: Third-party integrations may require additional authentication, involve separate terms and conditions, and pose security or privacy risks beyond our control.

15. Modifications

BinRadar reserves the right to modify these Terms, Platform features, API specifications, or service offerings at any time. Material changes will be communicated through:

Email notifications to registered users
Prominent notices on the Platform
API documentation updates
In-app notifications for mobile users

Updated Terms will be posted on the Platform, and your continued use signifies acceptance of the updated Terms. For significant changes affecting your rights or obligations, we will provide reasonable advance notice when feasible.

16. Termination

16.1 Termination by BinRadar

BinRadar may terminate or suspend your account and access to the Platform immediately, without prior notice, if you:

Breach these Terms or violate Platform policies
Engage in prohibited activities or illegal conduct
Pose a security risk to the Platform or other users
Violate applicable laws or regulations
Engage in abusive or fraudulent behavior

16.2 Termination by User

You may terminate your account at any time through your account settings or by contacting customer support. Upon termination:

Your access to the Platform will cease immediately
Your account data may be deleted in accordance with our data retention policies
Outstanding payment obligations remain in effect
Certain provisions of these Terms will survive termination

16.3 Effect of Termination

Upon termination by either party:

All licenses granted to you under these Terms immediately cease
You must stop all use of the Platform and API services
BinRadar may delete your account and associated data
Provisions regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination

17. Governing Law and Disputes

17.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the courts of England and Wales for any legal proceedings.

17.2 Dispute Resolution Process

Step 1: Direct Communication Before initiating formal proceedings, parties agree to attempt good faith resolution through direct communication for a period of sixty (60) days.

Step 2: Binding Arbitration Disputes arising out of or in connection with these Terms will be exclusively resolved by binding arbitration in London, England, according to the London Court of International Arbitration (LCIA) rules. The arbitration will be:

Conducted in English
Decided by a single arbitrator unless parties agree otherwise
Final and binding on all parties
Confidential except as required for enforcement

17.3 Exceptions

Either party may seek injunctive relief in court for:

Should any provision of these Terms be deemed invalid or unenforceable, the remainder of the agreement remains effective and enforceable. Invalid provisions will be deemed modified to the minimum extent necessary to make them valid and enforceable.

18.3 Assignment

BinRadar may assign these Terms or any rights hereunder without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.

18.4 Force Majeure

BinRadar shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

Natural disasters or acts of God
Government actions or regulatory changes
Network failures or cyberattacks
Exchange outages or market disruptions
Pandemics or other public health emergencies

18.5 Notices

All legal notices must be in writing and sent to the addresses specified in Section 19. Electronic notices will be deemed received when sent to your registered email address or posted prominently on the Platform.

18.6 No Waiver

BinRadar's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver will be effective unless made in writing and signed by BinRadar.
